Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Unstill mobile application and related websites and services (collectively, the “Service”) operated by Y CORP (“Y CORP,” “we,” “us,” or “our”).

By downloading, accessing, or using Unstill, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Who we are

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use Unstill. If you are under 18, you represent that you have a parent or guardian’s permission. You must have the legal capacity to enter into these Terms.

3. The Service

Unstill helps you interrupt long periods of sitting by running Work Mode sessions, movement blocks, challenges, scoring, and optional notifications. Unstill may charge in-app “Tokens” when you miss movement requirements according to your settings and the rules of the Service.

Unstill is provided for motivation and wellness habits. It is not a medical device and does not provide medical, health, or fitness advice. Always consult a qualified professional for health decisions.

4. Accounts

You may use sign-in options we offer (such as Sign in with Apple or Google). You are responsible for activity under your account and for keeping credentials and devices secure. Notify us promptly of unauthorized use.

5. Tokens and purchases

• Tokens are a digital feature of Unstill used within the app (for example, stakes for missed movement blocks). Tokens have no cash value outside the Service except where required by law, and are not redeemable for money.
• Token packs and other paid features are sold as in-app purchases through Apple App Store and/or Google Play. Those purchases are also subject to the store’s terms and refund policies.
• Prices may change. We do not guarantee uninterrupted availability of any pack or feature.
• Losing Tokens due to missed movement blocks, ending Work Mode, or other intended app mechanics is part of how Unstill works and is not a billing error.

6. Permissions and device requirements

Some features require device permissions (such as Motion & Fitness or notifications) and a compatible iPhone. You are responsible for granting or denying permissions. If you deny permissions, related features may be limited or unavailable.

7. Acceptable use

You agree not to:

• Misuse the Service, attempt to cheat motion detection, or interfere with others’ use;
• Reverse engineer, scrape, or attempt unauthorized access to our systems (except to the extent allowed by law);
• Use Unstill for any unlawful purpose;
• Impersonate others or misrepresent your affiliation with Y CORP.

8. Intellectual property

The Service, including software, design, text, graphics, logos, and trademarks (including Unstill), is owned by Y CORP or its licensors and is protected by intellectual property laws. Except for the limited right to use the Service as permitted in these Terms, no rights are granted to you.

9. Third-party services

Unstill may integrate with third-party services (for example, Apple, Google, and cloud providers). Your use of those services is subject to their terms and privacy policies. We are not responsible for third-party services we do not control.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, Y CORP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT MOTION DETECTION OR SCORING WILL BE PERFECT IN EVERY ENVIRONMENT.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Y CORP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO Y CORP FOR UNSTILL IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

12. Indemnity

You agree to defend, indemnify, and hold harmless Y CORP from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service or violation of these Terms.

13. Termination

You may stop using Unstill at any time. We may suspend or terminate access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive (including ownership, disclaimers, limitations, and indemnity) will survive termination.

14. Changes

We may update these Terms from time to time. We will post the updated Terms with a new “Last updated” date. Continued use after changes become effective constitutes acceptance. If you do not agree, stop using the Service.

15. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles, unless mandatory local consumer law in your place of residence provides otherwise. Courts in Delaware shall have exclusive jurisdiction, except where prohibited.
